الخصوصية في مجال حقوق الإنسان : الرؤى والمواقف الفکرية والدولية

الملخص:
 أضحت حقوق الإنسان إطاراً عاماً لکل المجالات الإنسانية، ومحوراً لدراسات معرفية شتى، کما لم يبقى الاهتمام بمها وبمدى احترامها منحصراً في ميدان معين أو مقتصر على فئة محدودة بل تجاوز المهتمين بها کل البقاع، حيث أصبحت حقوق الإنسان في عالمنا المعاصر قضية لها شأن إنساني عالمي، وليس کشأن وطني محلي، ولذا يجتمع أکثر الناس قرباً وبعداً عن حقوق الإنسان وبدرجات متفاوتة باعتباره سيمفونية الحقبة وهوية الأزمنة الحديثة .
وترتيباً على کل هذه المعاني السامية فإنه علاوة على ما أثاره المفهوم من جدل کبير حول مضمونه ، وتحديد أطره ، ومتى بدء وأين بدء ، فإنه وبقدر تلاشي اجماع الباحثين والمفکرين في الوقوف على تعريف موحد للمفهوم ، بالقدر ذاته تسري النظرة إلى المفاهيم والمبادئ العامة لحقوق الإنسان . هل هذه المفاهيم والمبادئ العامة لحقوق الإنسان هي مبادئ عالمية إنسانية واخلاقية تقرها جميع المجتمعات والحضارات ، أم أن هذه القيم بطبيعتها نسبية ومتغيرة فما يعتبره مجتمع ما قيمة أخلاقية لا ينظر مجتمع آخر النظرة نفسها ،  فکل مجتمع يفسر هذه المبادئ والمثل بطريقته .
حيث أنه من الثابت أن التغاير الثقافي أو الديني ...الخ ، بين الأمم والشعوب أمر ثابت لا يمکن إنکاره . زاد التمسک بهذا المبدأ اختلاط مفاهيم حقوق الإنسان العالمية بالعولمة ، والتي تثير العديد من الهيمنة والمخاوف والتعامل مع العالم دون اعتداد يذکر بالحدود السياسية أو الانتماء إلى وطن محدد أو دولة بعينها، وفقدان الکثير من الخصوصيات التي کانت تحتمي وراء الحدود ، ومن هذا المنطلق ، تتمسک الدول والشعوب بخصوصيتها الدينية والثقافية وتطالب بأن يعترف لها بهذه الخصوصية وأن يسمح لها بالمساهمة في بناء نظرة عالمية لحقوق الإنسان من دون أي خضوع وابتزاز ، وان تترجم الاتفاقيات الدولية لحقوق الإنسان على أرض الواقع دون تحيز وازدواجية في التعامل مع قضايا حقوق الإنسان .
وسنحاول في هذه الدراسة إبراز مبدأ خصوصية حقوق الإنسان ، والوقوق على وجهة نظر دعاة هذا الاتجاه في مجال حقوق الإنسان .
Abstract:
There is no concept raised considerable controversy over its content, identifying frameworks, as is the concept of human rights, it is and as much as raised by the concept of the controversy and the erosion of consensus, researchers and intellectuals to stand on a common definition of the concept, to the extent the same outlook applies to the general concepts and principles of human rights. Arethese concepts and general principles of human rights are universal principles of human and moral approved by all societies and civilizations, or that these values are relative by nature and changing what he considers society as a moral value not seen another same outlook community, every society explains the principles and ideals in his own way.
Since it is hard to cultural or religious heterogeneity ... etc., between nations and peoples is a constant it cannot be denied. Adhere to this principle increased mixing of universal human rights concepts to globalization, which raises many domination, fears and deal with the world without esteem little political borders or belonging to a specific country or a particular country, the loss of a lot of privacy, which was sheltering across the border, and from this standpoint, upholds the states and peoples' religious and cultural specificity and demanding that recognized her in this Privacy and allow them to contribute to building a global view of human rights without any subordination and blackmail, and that the international human rights conventions translated on the ground without bias and duplicity in dealing with human rights issues.
We will try in this study highlight the principle of human rights and privacy, and stand on the viewpoint of the advocates of this trend in the field of human rights.
